These Terms of Service ("Terms") constitute a legally binding agreement between you and Streat Grocery governing your access to and use of the Streat Grocery digital loyalty programme application. By completing the registration process and checking the consent box, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not register or use the service.

The Application is operated by:
The Application is a free-of-charge digital service that allows customers of Streat Grocery to: (a) earn Stamps on Qualifying Purchases by uploading receipts; (b) accumulate Stamps towards Reward Thresholds; (c) receive Vouchers automatically upon reaching a Reward Threshold; and (d) redeem Vouchers as discounts on future in-store purchases.
The Application is provided free of charge to customers. The commercial consideration underlying the programme is the customer's continued patronage of the store; no monetary payment is made by the customer for access to the Application or its features.
A binding agreement incorporating these Terms is formed when you: (a) complete the registration form; (b) check the consent checkbox confirming agreement to these Terms and the Privacy Policy; and (c) click "Create My Account". No agreement is formed before all three steps are completed.
These Terms are provided in English. In the event of any inconsistency between any translation and the English text, the English text prevails. These Terms are governed by German law (see Section 20).
We will store a copy of these Terms as they appeared at the time of your registration and as amended thereafter. You may request the version applicable at any time by emailing info@streatgrocery.com.
To register for and use the Application, you must:
Each natural person may hold only one Account. Creating multiple Accounts to accumulate Stamps across them is a breach of these Terms and may result in all associated Accounts being permanently suspended and all Stamps and Vouchers forfeited without compensation.
By registering, you represent and warrant that you meet all eligibility requirements. We reserve the right to request proof of eligibility (e.g., age verification) at any time and to suspend or close Accounts where eligibility cannot be confirmed.
Registration is completed by: (a) entering your email address on the login page; (b) entering the OTP delivered to that address (valid for 10 minutes); and (c) completing the registration form with your name, phone number, and any optional fields you choose to provide.
You are solely responsible for: (i) the security and confidentiality of your email account, which is your authentication method; (ii) all activity that occurs under your Account, whether or not authorised by you; and (iii) immediately notifying us at info@streatgrocery.com if you suspect unauthorised access to your Account.
We will never ask for your OTP by phone, email, or in person. If you receive such a request, treat it as fraudulent and report it to us immediately.
We reserve the right to suspend any Account where we reasonably believe a security incident has occurred, and to require re-verification before restoring access.
You earn one (1) Stamp for every complete €30 (or currency equivalent) spent in a Qualifying Purchase, as verified by an approved Receipt. Fractional stamps are not awarded; the number of Stamps for any given purchase is determined by dividing the verified purchase total by the stamp rate and rounding down to the nearest whole number. For example: a €75 purchase at a €30-per-stamp rate earns 2 Stamps, not 2.5.
The current stamp rate is displayed on your home screen and in the "How It Works" section of the Application. The rate may be changed pursuant to Section 9.
To claim Stamps for a Qualifying Purchase, you must:
Receipts from any source other than Streat Grocery will be rejected. We reserve the right to reject receipts that we reasonably believe to be fraudulent, forged, altered, digitally manipulated, or otherwise not genuine.
All receipts are subject to review — either automated (OCR extraction and validation) or manual (by an authorised staff member) — before Stamps are credited. We aim to complete reviews within 24 hours of submission on a Working Day, but this is a target, not a guarantee. Stamps are credited only upon approval.
We may request supporting information (e.g., proof of the original paper receipt) before approving a disputed receipt. Failure to provide requested supporting information within 7 days may result in rejection.
When your Stamp balance reaches a Reward Threshold, a Voucher is issued automatically to your Account. The current Reward Thresholds and associated Voucher values are:
After a Voucher is issued at the highest Reward Threshold, your Stamp counter resets to zero and you begin earning towards the next reward cycle. Stamps earned in excess of the highest Reward Threshold in a single transaction are carried over to the new cycle.
To redeem a Voucher: (a) open the Application on your device; (b) navigate to "My Card" to display your QR code (which encodes your active Voucher); (c) present the QR code to a member of staff at the till before the transaction is finalised; (d) the staff member will scan the code and apply the discount to your purchase total. Vouchers cannot be applied retrospectively after a transaction has been completed.
If the Application is temporarily unavailable due to a technical fault at the time of redemption, you may ask a staff member to manually record the Voucher code displayed on your Account and apply the discount. We will not unreasonably refuse a redemption request made in good faith where the temporary unavailability of the Application is not attributable to the customer.
Authorised staff and managers may adjust your Stamp balance to: (a) correct errors caused by an incorrect rejection of a valid receipt; (b) credit Stamps for a technical failure that prevented a receipt from being processed; or (c) reverse fraudulently awarded Stamps. All adjustments are logged in the audit system with the reason, amount, actor, and timestamp.
If you believe your Stamp balance is incorrect, or that a receipt has been incorrectly rejected, you may raise a dispute by:
We aim to resolve all disputes within 5 Working Days of receiving sufficient information. We will notify you of the outcome by email. Our decision, following a good-faith review, is final for the purposes of the loyalty programme, but does not affect any statutory consumer law rights you may have.
We reserve the right to change any aspect of the loyalty programme, including (without limitation): the Stamp earn rate, Reward Thresholds, Voucher values, and Voucher terms and conditions.
Your continued use of the Application after the effective date of a notified change constitutes acceptance of the changed terms for the programme.
If we decide to permanently discontinue the loyalty programme in its entirety, we will:
You agree that you will not, and will not attempt to:
Any breach of this section may result, at our sole discretion, in: immediate suspension or permanent termination of your Account; forfeiture of all accrued Stamps and Vouchers without compensation; and, where the conduct constitutes fraud or a criminal offence, referral to the relevant authorities and/or civil legal proceedings to recover losses.
All intellectual property rights in the Application and its content — including, without limitation, the software code, database structure, user interface design, text, graphics, logos, icons, images, and any other material — are owned by or licensed to Streat Grocery and are protected by German and international copyright law, trade mark law, database rights, and other applicable intellectual property legislation.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Application for the purposes contemplated by these Terms. This licence does not include the right to: (a) copy, reproduce, or distribute any part of the Application; (b) modify, adapt, translate, or create derivative works; (c) sub-license, sell, or otherwise exploit the Application or any part of it commercially; or (d) use any trade mark, logo, or other distinctive sign of Streat Grocery without prior written consent.
Where you upload receipt images or provide other content, you retain all intellectual property rights in that content but grant us a non-exclusive, royalty-free licence to process, store, and use that content solely for the purposes of operating the loyalty programme in accordance with these Terms and the Privacy Policy.
Nothing in these Terms limits or excludes any right you have as a consumer under applicable German law, including the Bürgerliches Gesetzbuch (BGB), the Gesetz gegen den unlauteren Wettbewerb (UWG), and any implementing legislation of EU consumer protection directives. In the event of any conflict between these Terms and mandatory applicable consumer protection law, the mandatory law prevails.
Under German law, consumers generally have a 14-day right of withdrawal from contracts for digital services concluded at a distance. However, pursuant to § 356(5) BGB, the right of withdrawal is extinguished if the provider has begun performance of a contract for the supply of digital content or a digital service before the expiry of the withdrawal period, and:
By checking the consent box during registration, you expressly request immediate performance of the digital loyalty service (i.e., immediate creation of your Account and activation of the stamp-earning functionality) and acknowledge that your right of withdrawal is thereby extinguished upon our commencement of performance. As the service is provided entirely free of charge, the extinguishment of the withdrawal right involves no financial detriment to you.
If you do not wish to waive the withdrawal right, do not check the consent box. You may close your Account at any time via My Account → Danger Zone → Delete My Account.
To the fullest extent permitted by applicable law (subject always to Section 14.4 below), we disclaim all representations and warranties, whether express or implied, statutory or otherwise, including warranties of satisfactory quality, fitness for a particular purpose, non-infringement, and compatibility with your device or software environment.
In particular, we do not warrant or represent that:
Subject to Sections 14.2 and 14.4, our total aggregate liability to you arising out of or in connection with these Terms or your use of the Application, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed:
Subject to Section 14.4, and to the extent permitted by applicable German law, we shall not be liable to you for:
You acknowledge that the Application is provided entirely free of monetary charge, and that the allocation of risk in Sections 13 and 14 reflects this. The limitation of liability in Section 14.1 is reasonable having regard to the fact that you pay nothing to use the service.
Nothing in these Terms excludes or limits our liability for:
You may close your Account and terminate these Terms at any time by navigating to My Account → Danger Zone → Delete My Account and confirming by typing "DELETE". Account closure is effective immediately, subject to a 30-day data deletion window as described in the Privacy Policy. All accrued Stamps and unredeemed Vouchers are permanently forfeited on closure, with no compensation payable.
We may suspend or permanently terminate your Account, with or without prior notice depending on the severity of the cause, if:
Where we terminate for cause, all accrued Stamps and Vouchers are forfeited without compensation. We will inform you of the termination and the reason where we are legally permitted to do so.
Where we close your Account for reasons not attributable to your breach of these Terms (for example, as a consequence of programme discontinuation under Section 9.2), any Vouchers validly held in your Account at the date of closure notice will be honoured in-store for a period of 90 days from the date of the closure notice, upon presentation of proof of identity and the Voucher code.
Neither party shall be in breach of these Terms or liable for any failure or delay in performance of obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond that party's reasonable control, including but not limited to: acts of God; pandemic or epidemic; governmental actions or regulations; civil unrest; strikes or industrial action (other than involving that party's own employees); failure of internet infrastructure or telecommunications networks not operated by that party; or cyberattacks by third parties despite reasonable security measures being in place ("Force Majeure Event").
The party affected by a Force Majeure Event shall notify the other as soon as reasonably practicable and shall use commercially reasonable endeavours to mitigate the impact of the Force Majeure Event. If the Force Majeure Event continues for more than 90 consecutive days, either party may terminate these Terms on 14 days' written notice without liability to the other, except that any Vouchers already validly earned shall be honoured pursuant to Section 15.3.
The collection and processing of your personal data in connection with the Application is governed by our Privacy Policy, which is incorporated into these Terms by reference and forms part of the agreement between us. By accepting these Terms, you confirm that you have read and understood the Privacy Policy.
In the event of any conflict between these Terms and the Privacy Policy on a matter of data protection, the Privacy Policy shall prevail.
We may update these Terms from time to time. Changes are categorised as follows:
All versions of these Terms are stored internally and available on request at info@streatgrocery.com.
These Terms, together with the Privacy Policy incorporated by reference, constitute the entire agreement between you and us with respect to your use of the Application and supersede all prior agreements, representations, warranties, and understandings, whether written or oral, relating to the same subject matter.
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable, or if such modification is not possible, shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect. Sections 14.1 and 14.2 shall be read together; if either is found unenforceable, the other shall not automatically fail.
No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy. No single or partial exercise of any right or remedy shall preclude or restrict any further exercise of that or any other right or remedy. Waiver of any breach shall not be deemed a waiver of any subsequent breach of the same or any other provision.
You may not assign, transfer, sub-license, or otherwise deal in any way with your rights or obligations under these Terms without our prior written consent. We may assign our rights or obligations under these Terms to a successor entity (including in connection with a merger, acquisition, or business transfer) provided the assignee agrees to be bound by these Terms with respect to you. We will notify you of any assignment within 30 days.
These Terms do not create any rights that are enforceable by any person who is not a party to them (Vertrag zugunsten Dritter), unless expressly stated. The Contracts (Rights of Third Parties) Act 1999 does not apply (this agreement is governed by German law).
Any notice or communication under these Terms shall be in writing (email is acceptable). Notices from us to you will be sent to your registered email address and will be deemed received 24 hours after sending. Notices from you to us should be sent to info@streatgrocery.com and will be deemed received when we acknowledge receipt by email reply.
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you habitually reside shall not be prejudiced by this choice of law (Art. 6(2) Rome I Regulation).
In the event of a dispute, we encourage you to contact us first at info@streatgrocery.com. We will use reasonable endeavours to resolve disputes amicably and promptly. We aim to respond to all complaints within 5 Working Days.
The European Commission makes available an online dispute resolution (ODR) platform pursuant to Regulation (EU) No 524/2013. The platform may be accessed at: https://ec.europa.eu/consumers/odr. Our email address for ODR purposes: info@streatgrocery.com.
We are not obligated to participate in consumer arbitration proceedings before a Verbraucherschlichtungsstelle (consumer arbitration board) and do not currently participate in any such scheme. We are, however, willing to do so in good faith if mutually agreed.
Subject to mandatory consumer protection law in your country of habitual residence, you agree that any dispute not resolved informally shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany. If you are a consumer resident in an EU member state, you also have the right to bring proceedings in the courts of your country of habitual residence.
These Terms of Service were prepared in accordance with: the Bürgerliches Gesetzbuch (BGB), including §§ 305–310 (AGB-Kontrolle), §§ 355–359 (Widerrufsrecht), and §§ 241–248 (obligations); the Gesetz gegen den unlauteren Wettbewerb (UWG); EU Directive 2011/83/EU on consumer rights; EU Directive 2019/2161 (Omnibus Directive); Regulation (EU) No 524/2013 (ODR Regulation); Regulation (EU) 2016/679 (GDPR); and applicable guidance from the Verbraucherzentrale Bundesverband (vzbv).
